By accessing the website located on the following URL address: www.caixacapitalrisc.com, or whichever that may substitute it (from now on “the Portal”) and browsing the information it contains, as well as by hiring any of the services, free or paid, available on the Portal, the user accepts the terms and conditions established in the present Legal Notice, and therefore, we recommend you read it carefully.

Validity of the Legal Notice

CAIXA CAPITAL RISC, SGEIC, S.A., domiciled in Barcelona, Av. Diagonal, 621-629, with tax identification number A-62.794.722, registered at the Barcelona Business Registre in volume 34.341, sheet number 207, page number B-247.079, is the holder and manager of the Portal (hereinafter referred to as the “Portal’s Holder”).

The Owner of the Portal reserves their right to modify the conditions foreseen in this Legal Notice at any time, in which case, any possible modifications will be valid from the moment they are published and will be applicable from that date onwards.

Unless it is specifically stated otherwise, the contents found on the Portal and, especially in the case of those related to resources, tools and services, do not constitute a binding offer. The Owner of the Portal reserves the right to introduce modifications or to omit, partially or fully, the current contents whenever they see fit, as well as to restrict or suspend access to them temporarily or permanently.

The availability of services, information, resources and/or tools of any nature on the Portal, will not, under any circumstances be considered an offer of provision of services, a commercial offer and/or a contractual agreement with the Owner of the Portal, or in any way generate an obligation under the responsibility of the owner, unless it is specifically stated otherwise.

Definitions:

To the effects foreseen in the present Legal Notice the following will be understood as:

User: Any person that visits the Portal.

Entrepreneur: Any natural or legal person that wishes to create, develop or consolidate projects or business initiatives, research or innovation, that registers on the Portal with the intention of making use of resources and tools of any nature that are accessed through the Portal, for the fulfilment or development of a personal project or seeking advice on any of the aspects relative to the project.

Investor: Any natural or legal person registered on the Portal, interested in promoting or participating in the financing of Entrepreneur’s projects in different industries.

Expert: Any natural or legal person registered on the Portal and equipped with experience and knowledge that can be of use for Entrepreneurs and would like to extend said knowledge to them by launching new projects, contributing new information to the Portal and/or would like to assist Entrepreneurs – either on-line or through any other channel -.

Collaborating Entity: Any legally independent entity that, without being an Investor or an Expert, contributes any type of content to the Portal, such as offering courses or information on certain fields, in collaboration with the Owner of the Portal.

If someone that collaborates by contributing content to the Portal that constitutes an offer of a product or service through the Portal, under any circumstance, must specify it to the Owner of the Portal, exonerating the owner from any responsibility that may derive from the compliance or non-compliance of the obligations that they may be incurred, as well as of the responsibility derived from any infraction that may be incurred in virtue of the rules of Advertising, Industrial and Intellectual Property, Unfair Trade, Personal Data Protection, Consumer and User Protection, or of any other nature.

In particular, it will not be understood that the management of the Portal by its owner entails the participation and/or linking of the latter, in contractual and/or commercial relationships or of any kind that, if applicable, may be established between Users, and therefore, said holder will not be responsible, under any circumstances, for the compliance of the obligations that may arise from said relationships. For these purposes, it will be understood that all Users act independently and autonomously in its relations with other Users of the Portal.

Industrial and Intellectual Property:

The content on the pages comprised in the Portal, include or can include, texts, documents, multimedia, photographs, illustrations, logos, brands, commercial names, Internet domain names and other distinctive signs protected by the rights of intellectual or industrial property or by the image rights of the rightful owners or legitimate licensees, or the holder of the Portal or natural or legal persons who participate in the contribution of contents to the same, or authorize their use for that purpose, whether it be Entrepreneurs, Experts, Investors, Collaborating Entities or Users.

Any form of exploitation, including all types of reproduction, distribution, assignment to third parties, making available or public communication and transformation, through any type of support and means, of the aforementioned works, creations and distinctive signs, is prohibited without prior and explicit authorization of their respective holders. Failure to comply with this prohibition may constitute an offense punishable by current legislation.

However, at their own risk, Users may download or make copies of such elements exclusively for his personal use, without means an authorization or license on the property rights of the owner of the Portal or third parties referred to above. In particular, Users may not alter, modify or delete in whole or parts of any of these elements, nor in general, infringe any of the intellectual or industrial property rights of the owner of the Portal or third parties.

In addition to the above, the contents of the Portal and especially those inventions whose characteristics are outlined in the Portal and/or the parts of projects promoted by Caixa Capital Risc that may be protected by industrial property rights and/or protected as patents, Trademarks, trade names and/or establishment signs, even if this circumstance is not expressly mentioned, and any form of exploitation thereof, including all types of reproduction, distribution, assignment to third parties, public communication and transformation, through any type of medium, unless it is expressly authorized by its owner.

Except in cases where it has been expressly authorized by the Portal’s owner, it is prohibited to establish links, hyperlinks or links between portals or websites of third parties and the Portal, as well as to present all or part of the Portal’s web pages or the information contained in it under frames or macros, distinctive signs, social or commercial names of third parties, which, in any other way, are associated with the image or trade name of the Portal owner, and are susceptible of inducing error, confusion or deception.

The owner of the Portal does not grant any guarantee regarding the accuracy and/or legality of the information or elements contained in the pages of the Portal when they have not been prepared or owned by the same.

Responsibilities:

The owner of the Portal does not guarantee the continued access, nor the correct visualization, download or use of the elements and information contained in the Portal, which can be impeded, hindered or interrupted by circumstances beyond its control.

The owner of the Portal is not responsible for (i) the information and other contents integrated in spaces or web pages of third parties accessible through the Portal through links or hyperlinks (ii) those from which the Portal can be accessed by, (iii) the information and contents of any third-party webpage that is presented under the appearance or distinctive signs of the owner of the Portal or licensed to the same by third parties.

The owner of the Portal is not responsible for the information, content of any type, products and/or services offered and/or provided through the Portal by third parties and in particular, damages, losses, claims or expenses of any type that, linked to the above, could have been produced by:

Decision making based on the information accessible from the Portal or contained in it;

Veracity, accuracy, suitability and sufficiency of the information provided by the Portal to the Users;

Infringement or damage made by Users of legitimate interests and/or intellectual and industrial property rights (especially those that may correspond to Users collaborating in the contribution of contents to the Portal), acts of unfair competition or Illicit advertising;

Infringement of the obligations that may be applicable depending on its activity, either those provided by law in relation to services of the information society, general contracting conditions, protection of users and consumers, etc;

Failure to comply with data protection legislation; Obligations relating to professional secrecy, rights of honour, personal and family privacy and the image of people;

Illegitimate intrusion through the use of malicious programs of any kind and through any means of communication, such as computer viruses, or improper or inappropriate use of the webpages of the Portal.

Errors in the security or navigation caused by a malfunction of the browser or the use of non-updated versions of it and

In general, the non-compliance with any applicable laws, customs or codes of conduct.

Similarly, the owner of the Portal is not responsible for the content or manifestations that could be made in any forum or debate accessible from the Portal, assuming the User is exclusively responsible for the consequences of any manifestation that the same can carry out with illegal, defamatory or immoral content. Notwithstanding the impossibility of controlling the manifestations that may be carried out in such means beforehand, the owner of the Portal reserves the right to prevent or prohibit access to any User who enters the portal content in any way contrary to law, morality or public order, reserving also the right to exercise the legal measures that it deems appropriate to avoid this type of conduct.
